What is DACA? 

Deferred Action for Childhood Arrivals (DACA) is a policy to make provisions for young immigrants who traveled to the United States unlawfully as children. DACA is not a way to achieve citizenship, and the rights afforded in DACA are limited. However, DREAM-ers are lawfully able to obtain a driver’s license, a work permit, and a social security number. DACA eligibility

Not sure if you’re eligible for DACA? This is a fairly recent policy and it applies only to a specific timeframe. You are eligible for DACA if:

  • You entered the United States unlawfully before the age of 16
  • You have lived in the US as a continuous resident since 2008
  • You were under the age of 31 as of 2012
  • You were physically present in the United States on June 15, 2012 and at the time you applied for DACA
  • You were without a lawful status in the US as of June 15, 2012
  • You are enrolled in school, have completed high school or a GED, or were honorable discharged from the military
  • You have not been convicted of a felony, serious misdemeanor, or 3+ misdemeanors
  • You do not pose a threat to national or public safety

 

How to apply for DACA? 

To apply for DACA, you will need to fill out two forms: the Form I-821D (Consideration for DACA) and the Form I-765 (Application for Employment Authorization Document). Along with these forms, you will need to pay the application fee, which is $495 including biometrics. File these forms along with supporting documents to prove your identity, proof of current and prior residency, education, presence in the United States at relevant dates, criminal history and more.

Once the applications are filed, you will also need to set up a biometrics appointment at the nearest USCIS center. At the end of your biometrics appointment, you should know whether or not you’ve been approved for DACA.
