What is temporary protected status? 

Temporary protected status (TPS) is reserved for situations in which a foreign country is in such severe conditions that nationals of that country are not able to safely return home. The Department of Homeland Security designates TPS status, after which point protected nationals are not able to be removed from the United States and can apply for an EAD and be granted travel authorization. 

A TPS designation is typically given in situations where a temporary conflict or disaster – such as a civil war, epidemic, large scale natural disaster, or other extraordinary and temporary situations – has occurred. TPS does not prevent protected nationals from applying for an adjustment of status so as to become a permanent resident.

There are fourteen countries currently designated for TPS:

  • Afghanistan
  • Burma (Myanmar)
  • El Salvador
  • Haiti
  • Honduras
  • Nepal
  • Nicaragua
  • Somalia
  • Sudan
  • Syria
  • Ukraine
  • Venezuela
  • Yemen

 

TPS eligibility 

Wondering if you’re eligible for TPS? Here are the requirements:

  • Must be a national or habitual resident of a TPS designated country;
  • Must have been physically present in the US since the effective date of the TPS designation;
  • Must be a continuous resident of the US since the effective date of TPS designation;
  • Must not have been convicted of a felony or 2+ misdemeanors in the US;
  • Must file during the initial registration or re-registration period, unless you qualify for late initial filing
