¿Qué son las apelaciones de inmigración?

¿Cuándo debe presentar una apelación de inmigración? 

Una apelación de inmigración se presenta después de recibir un veredicto desfavorable en un caso o petición. Su abogado debe presentar la notificación de apelación dentro de los 30 días siguientes al veredicto para que sea considerada. Después de ese momento, la decisión del juez será definitiva y no se podrá apelar. 

El proceso de apelación de inmigración 

Una vez presentada la notificación de apelación, la BIA enviará un acuse de recibo, así como un calendario de reuniones, una fecha límite y una copia de la transcripción del juez. A partir de ahí, su abogado preparará el escrito de apelación. Es fundamental cumplir con el plazo establecido por la BIA para este escrito. Si no se cumple el plazo o se amplía, su apelación será rechazada.
