Cuando el solicitante y el cónyuge beneficiario hayan estado casados por menos de dos años en el momento en que se apruebe su green card, su residencia será condicional. La residencia condicional significa que el estado de la green card condicional solo se puede eliminar mediante una petición conjunta o mediante una renuncia si la petición conjunta no se puede presentar.
Si el residente condicional aún está casado con el cónyuge ciudadano estadounidense solicitante, el esposo y la esposa deben presentar una petición conjunta. Las partes presentarán conjuntamente una petición para eliminar las condiciones de residencia dentro del período de 90 días anterior al segundo aniversario de la fecha de la residencia condicional. La petición debe ir acompañada de pruebas que demuestren que el matrimonio se celebró de buena fe. Ejemplos de tal evidencia incluyen prueba de copropiedad de propiedad, mezcla de finanzas (por ejemplo, formularios de impuestos, extractos bancarios, pólizas de seguro), certificados de nacimiento de niños, fotos de la pareja tomadas durante el matrimonio, declaraciones de personas que tienen conocimiento de su matrimonio y otra documentación que establezca una relación marital de buena fe. Si el USCIS determina que el matrimonio calificado se celebró de buena fe, aprobará la petición conjunta, eliminará el estado condicional y otorgará el estado de residencia permanente, una green card de diez años.
¿Qué sucede cuando los cónyuges se separan o se divorcian durante el estado condicional?
No todos los matrimonios funcionan como se esperaba. La ley de inmigración permite una exención cuando un inmigrante no puede presentar una petición conjunta con su cónyuge ciudadano estadounidense. La Sección 216(c)(4) de la Ley de Inmigración y Nacionalidad (INA) prevé una exención en los casos en que no se pueda presentar una petición conjunta para eliminar la residencia condicional. Las tres bases independientes para una exención son: 1) el inmigrante sufrirá dificultades extremas si es removido; 2) el matrimonio se celebró de buena fe pero el matrimonio calificado ha terminado; y/o 3) el matrimonio se celebró de buena fe y el inmigrante fue objeto de agresión o crueldad extrema.
