¿Qué es FOIA? 

La Ley de Libertad de Información, 5 USC § 552, se estableció por primera vez en 1967. La Ley de Libertad de Información, o FOIA, ofrece a cualquier persona el derecho legal de acceso total o parcial a cualquier información no publicada anteriormente de las agencias del poder ejecutivo del gobierno. Haga una solicitud de FOIA para obtener la información que necesita y su derecho será ejecutado por la corte.

Cuando se trata de su caso de inmigración, es posible que necesite ciertos registros gubernamentales para presentar su caso. Puede presentar una solicitud FOIA para:

¿Cómo presentar una solicitud FOIA? 

No se utiliza un formulario específico para realizar una solicitud FOIA. Simplemente envíe la solicitud a la oficina de FOIA de la agencia de inmigración. Su solicitud debe “describir razonablemente” los documentos que necesita solicitar. Las solicitudes se pueden enviar a través de formulario web, fax, correo electrónico o por correo postal.

FOIA TYPES

  • US Citizen and Immigration Service FOIA- This type of request will disclose any and all applications filed with USCIS. At times, court records from the Department of Justice may appear, as well as certain border apprehensions before the year 2000. 
  • OBIM FOIA- This type of request is made via fingerprints, and will help obtain records from apprehension at the border, where fingerprints were collected.  It may also disclose any biometric appointment record in existance. 
  • Customs and Border Patrol FOIA- This type of request will help us find apprehension at the border after the year 2000 by border patrol.  It can also yield apprehensions within the U.S. at any border or CBP checkpoint. 
  • Department of State FOIA-  This request facilitates locating records from any consulate where an application for admission into the U.S. was made including but not limited to Non Immigrant Visa and Immigrant Visa applications. 
  • Department of Labor FOIA- This type of request is helpful to locate any application made for a labor certification when an application has been in the process of applying for an employment based visa. 

 

Tipos de FOIA
