¿Qué es el Estatus Especial de Inmigrante Juvenil (SIJS)?

Elegibilidad del SIJ

Para ser elegible para el SIJ, usted debe

  • Ser menor de 21 años en el momento de presentar la solicitud
  • Vivir en los Estados Unidos
  • No estar casado
  • Ser capaz de demostrar que es un dependiente de la corte o de una agencia estatal y que no puedes reunirse con sus padres debido a abuso, abandono o negligencia
  • Ser elegible para el consentimiento del USCIS en el momento de presentar la solicitud
  • Tener el consentimiento por escrito del Departamento de Salud y Servicios Humanos o de la Oficina de Reubicación de Refugiados

 

¿Cómo se solicita el SIJS? 

Para solicitar un SIJS, debe completar el formulario I-360 de petición de visa. Al hacerlo, es posible que quede exento de ciertas normas debido a su condición de inmigrante juvenil especial. Una vez presentada la solicitud, el USCIS puede determinar si cumple los requisitos para obtener el SIJS y, por tanto, una visa o una green card (residencia permanente). Durante el tiempo que su solicitud esté pendiente, puede solicitar la documentación de autorización de empleo.
