What is a fiance visa? 

A fiance visa is sometimes known as a K visa. It is a visa that allows you to lawfully enter the United States to join your fiance, as long as the two of you marry within 90 days. After that point, you may apply for a family based green card to become a permanent US resident. 

K Visa eligibility

Not all engagement situations allow for a K visa. You are eligible for a fiance visa if:

  • The sponsor fiance (the fiance in the United States) is a US citizen (green card permanent residents do not qualify);
  • You are both of age and eligible for marriage;
  • The legitimacy of your relationship can be proved through evidence like photographs, flight itineraries, letters or text messages, written statements from friends;
  • You can prove that you have met in person at least once in the past two years (some exceptions allowed for certain cultural, social, and religious norms);
  • You can sign a written agreement to marry within 90 days of the sponsored fiance’s arrival; and
  • The sponsor fiance meets the set out income requirements.

 

How long does it take to get a fiance visa? 

 This typically is determined by the processing times published by the USCIS in their website. It is important that the processing times are reviewed with the receipt notice of your fiance application.  The fiance visa,  Form I-129F,  must first be adjudicated by the USCIS.  After it is approved it is forwarded to your embassy for an interview and issuance of the Fiance Visa.
