Temporary Protected Status

In cases where you can’t return safely to your home country, you may be eligible for a temporary protected status. Learn more about how LA Legal Advocates can help you file for this today.

What is temporary protected status?

Temporary protected status (TPS) is reserved for situations in which a foreign country is in such severe conditions that nationals of that country are not able to safely return home. The Department of Homeland Security designates TPS status, after which point protected nationals are not able to be removed from the United States and can apply for an EAD and be granted travel authorization.

A TPS designation is typically given in situations where a temporary conflict or disaster – such as a civil war, epidemic, large scale natural disaster, or other extraordinary and temporary situations – has occurred. TPS does not prevent protected nationals from applying for an adjustment of status so as to become a permanent resident.

Countries designated for TPS

There are fourteen countries currently designated for TPS:

  • Afghanistan
  • Burma (Myanmar)
  • El Salvador
  • Haiti
  • Honduras
  • Nepal
  • Nicaragua
  • Somalia
  • Sudan

  • Ukraine
  • Venezuela
  • Yemen
