Defensa de Apelación

La Junta de Apelaciones de Inmigración, o BIA, es la máxima autoridad con respecto a la ley de inmigración. Si se le ha negado una visa U, una green card o se enfrenta a una deportación, es posible que pueda apelar ante la BIA, lo que resultará en una audiencia de la junta.

¿Qué son los derechos de apelación en inmigración?

Cuando su caso de inmigración ha sido denegado, puede ejercer sus derechos de apelación ante el foro de apelación correspondiente. Si su caso ha sido denegado, es esencial actuar con rapidez para preservar sus derechos de apelación dentro del plazo asignado impuesto. Tipos de apelaciones:

Apelación ante la Junta de Apelaciones de Inmigración

Cuando un no inmigrante recibe una decisión desfavorable de un tribunal de inmigración, la persona puede tener derecho a apelar su caso ante la Junta de Apelaciones de Inmigración. La apelación ante la BIA debe presentarse dentro de los 30 días siguientes a la decisión desfavorable.

Apelación ante el Tribunal de Apelaciones del Noveno Circuito

La petición de revisión debe presentarse a más tardar 30 días después de la fecha de la orden final de expulsión. Una petición de revisión ante el Tribunal de Apelaciones del Noveno Circuito puede revisar una orden final de expulsión sólo si “el extranjero ha agotado todos los recursos administrativos disponibles para el extranjero por el momento”. Las decisiones adversas de la Junta de Apelaciones de Inmigración pueden ser revisadas por este tribunal.

Apelaciones con la Oficina de Apelaciones

La oficina de Apelaciones Administrativas puede revisar ciertas categorías de decisiones desfavorables emitidas por los servicios de ciudadanía e inmigración de Estados Unidos. Las apelaciones de la AAO deben presentarse en un plazo de 30 días a partir de la denegación del USCIS.
