What are immigration appeals?
Whether your petition was denied or you lost a removal defense case, your attorneys may file an appeal with the Board of Immigration Appeals (BIA) in order to attempt to overturn an unfair ruling. Your immigration appeals lawyer will lay out the case before the BIA as to why the ruling was in error. If the BIA rules in your favor, the ruling will be overturned and sometimes reversed.
When should you file an immigration appeal?
An immigration appeal is filed after you receive an unfavorable verdict on a case or petition. Your attorney must file the Notice of Appeal within 30 days of the verdict in order to be considered. After that point, the judge’s decision will be finalized and no appeals will be possible.
The immigration appeal process
Once a Notice of Appeal has been filed, the BIA will send a confirmation of receipt, as well as a briefing schedule, deadline, and a copy of the judge’s transcript. From there, your attorney will prepare the brief for the appeal. It is crucial to meet the deadline set out by the BIA for this brief. If the deadline is not met or extended, your appeal will be rejected.
After your attorney files the brief, it’s a waiting game while the BIA reviews the brief and comes to a decision. This usually happens within a few months, though the timeline may vary depending on the complexity of the case. It’s important to have the right attorneys on your side in order to ensure that your appellate brief best represents your case.
